1. Acceptance of Terms

By accessing or using BharatReviews ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you may not use the Service. These terms apply to all users of the platform, including business owners, their staff, and guests who interact with the review flow.

2. Description of Service

BharatReviews is a QR-based review collection platform that helps businesses collect structured guest feedback. The Service includes:

• QR code generation for each business location
• A guided review flow where guests rate their experience and provide feedback
• Automated review draft suggestions based on guest feedback
• A private feedback channel for complaints and low ratings
• Analytics dashboards and reporting for business owners
• Email and WhatsApp notifications
• Google review analysis and insights

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• One account per individual; one business per account unless on a multi-location plan
• You must be at least 18 years old to create an account
• You are responsible for all activity that occurs under your account. Notify us immediately at hello@bharatreviews.app if you suspect unauthorised access

4. Plans & Billing

• The Free plan is available at no cost with limited features and submission limits
• Paid plans (Growth, Enterprise) are billed monthly or annually as displayed on the pricing page
• Plan upgrades are processed upon request and activated after confirmation
• Draft review submission limits reset at the start of each calendar month; unused submissions do not roll over
• Prices are in Indian Rupees (INR) and are subject to change with prior notice
• Refunds are handled on a case-by-case basis; contact support for refund requests

5. Acceptable Use

You agree NOT to:

• Use the Service to generate fake, misleading, or fraudulent reviews
• Submit reviews on behalf of guests without their knowledge or consent
• Spam guests with unsolicited review requests outside the platform
• Attempt to manipulate ratings, analytics, or review content in a deceptive manner
• Use the Service to harass, defame, or intimidate any person
• Reverse-engineer, scrape, or exploit the Service for competitive purposes
• Violate any applicable local, state, national, or international law

Violation of these terms may result in immediate account suspension or termination without refund.

6. Automated Content

• The Service uses automated tools to generate review draft suggestions based on guest feedback. These drafts are suggestions only.
• Guests are presented with the draft and can edit, modify, or discard it before posting. The guest is solely responsible for the final content they post on Google or any other platform.
• BharatReviews does not guarantee the accuracy, appropriateness, or quality of automated draft text.
• BharatReviews is not liable for any consequences arising from reviews posted by guests, including but not limited to legal claims, reputation damage, or disputes.

7. Guest Data Responsibilities

As a business owner using BharatReviews, you agree to:

• Inform your guests that their feedback is being collected through BharatReviews
• Not misuse, sell, or share guest contact information (phone numbers, names) obtained through private feedback
• Use private feedback constructively to improve your service, not to retaliate against guests
• Comply with applicable data protection laws regarding guest information

8. Intellectual Property

• The BharatReviews platform, including its design, code, branding, and documentation, is owned by BharatReviews and protected under applicable intellectual property laws
• Business owners retain ownership of their business data (logos, business information)
• Guest-submitted feedback and review content belongs to the guest who created it
• Automated review drafts are not claimed as intellectual property by BharatReviews
• You may not use the BharatReviews brand, logo, or name without prior written permission

9. Service Availability

• We strive to keep the Service available 24/7 but do not guarantee uninterrupted access
• Scheduled maintenance, infrastructure updates, or unforeseen technical issues may cause temporary downtime
• We are not liable for any losses arising from service interruptions or downtime
• Third-party service outages (Google, WhatsApp, email providers) are beyond our control

10. Limitation of Liability

To the maximum extent permitted by law:

• BharatReviews is provided "as is" without warranties of any kind, either express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• We are not responsible for the content of reviews posted by guests on Google or other platforms
• We are not liable for any business decisions made based on analytics or feedback data
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim

11. Subscription & Billing

• Paid plans are billed on a recurring basis (monthly or yearly) through Razorpay, our payment gateway partner
• By subscribing to a paid plan, you authorize BharatReviews to charge your chosen payment method at the beginning of each billing cycle
• Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date
• We will notify you at least 30 days in advance of any price changes to existing plans
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period
• No pro-rated refunds are provided for mid-cycle cancellations. See our Refund Policy for details
• Failed payments will be retried automatically. After multiple failures, your subscription may be suspended and your account downgraded to the Free plan
• All prices are in Indian Rupees (INR) and inclusive of applicable GST (18%)
• BharatReviews does not store your card or bank details. All payment data is processed securely by Razorpay in compliance with PCI DSS standards

12. Termination

• You may delete your account at any time by contacting support
• We may suspend or terminate your account if you violate these terms
• Upon termination, your business data and review sessions will be retained for 30 days, after which they will be permanently deleted
• Termination does not entitle you to a refund for any unused portion of a paid plan, unless agreed otherwise

13. Governing Law & Disputes

These terms are governed by and construed in accordance with the laws of India. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

14. Changes to These Terms

We may update these Terms & Conditions from time to time. If we make material changes, we will notify registered business owners by email. The "Last updated" date at the top of this page indicates when these terms were last revised. Continued use of the platform after changes constitutes acceptance of the updated terms.
